Corbett & Co. have acted in some of the largest energy construction projects in the world. These include nuclear build and decommissioning projects, coal-fired and diesel power stations, wind farms, hydroelectric power stations, and waste to energy plants. We also have significant experience of working on the construction of dams across the world with clients including governments, operators and contractors in Africa, Asia, and Europe.

Whilst some of these projects had bespoke contracts, many were heavily amended FIDIC forms, including the FIDIC Yellow and Silver Books, or MF1. One such project involved advising a package contractor in the nuclear industry on a contract based on the Yellow Book, which had been developed for a proposed major new build project in the UK. We have experience in advising contractors and suppliers on nuclear decommissioning projects for both legacy facility design and implementation phases based on IChemE forms. We have also advised on associated specialist equipment design, manufacture and supply using NEC forms and client/employer bespoke terms.

Our experience in the energy sector covers all stages of work. We have assisted in drafting particular conditions of contract for projects as well as acting as advocates before FIDIC Dispute Adjudication Boards, in arbitrations and in litigation. We provide advisory services to prevent potential disputes arising but we also assist in preparing claims and representing our clients in ADR, arbitration and litigation proceedings and also assist with procurement strategies for the project and drafting conditions of contract.

  • Fitness for Purpose Højgaard and FIDIC’s Yellow Books

    MT Højgaard AS v E.ON Climate and Renewables UK Robin Rigg East Ltd & Anor is an important English case because it considered a fitness for purpose obligation in a design and build contract. In FIDIC’s Yellow Book contracts (1999 and 2017) there are also fitness for purpose obligations. This article examines the Supreme Court’s analysis of a fitness for purpose obligation in the Højgaard case and whether it would be applied to FIDIC’s Yellow Book contracts.
